Welcome to Custom Health. These Terms of Use (“Terms”) explain the rules for using the Custom Health website, applications, devices, digital tools, and related content (collectively, the “Services”). 

For convenience, we’ve included a short summary. The complete Terms of Use below are legally binding.

  • Custom Health provides medication support tools, clinical oversight, connected devices, and digital pharmacy services.

  • Information on this website is not medical advice. Decisions about diagnosis and treatment belong to licensed healthcare providers.

  • Using our website means you agree not to misuse, copy, or reverse engineer our content, software, or technology.

  • Device-enabled services rely on connectivity and proper use. Notifications and monitoring are not guaranteed.

  • Some services (such as device or monitoring programs) may require separate enrollment or consent. Routine pharmacy dispensing typically does not require a separate contract. Where program-specific agreements exist, they govern care and will override this page if there’s any conflict.

  • We protect our trademarks, content, software, and platform IP (including AdhereNet®, spencer®, PatchCap™, oneMAR®).

  • We may update our Terms. Continuing to use the site means you accept the latest version.

Terms of Use

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and all applicable laws. If you do not agree, do not use the Services.

Use of certain features — such as enrollment in patient programs, pharmacy services, remote monitoring, or provider partnerships — may require additional agreements.

2. Relationship to Other Agreements

Some Custom Health programs and services may require separate written or electronic agreements — for example, device activation, remote monitoring enrollment, data-sharing authorization, or provider/commercial partnerships. Examples include:

  • patient device or monitoring program enrollment (e.g., spencer®, PatchCap™, RTM/RPM)

  • pharmacy consent or HIPAA/PHI authorization where required by law (routine pharmacy dispensing does not require a separate service contract; acknowledgment of the Notice of Privacy Practices (NOPP) or related regulatory consent still applies. Device or monitoring programs may require enrollment or additional consent)

  • device activation or connected service setup

  • provider or health system agreements

  • enterprise, payer or commercial contracts

Where program-specific agreements apply, those terms will take precedence to the extent of any conflict.

These Terms govern general access to the website and informational use only, and do not create a patient-provider relationship or replace standard pharmacy consent associated with filling a prescription.

3. No Medical Advice

The Services are for general information only and are not medical advice, diagnosis, or treatment.
Medication decisions remain the responsibility of licensed healthcare professionals.

4. Overview of Services

Custom Health provides technology-enabled medication management, pharmacy services, remote monitoring programs, and connected device support. Many of our Services are enabled by AdhereNet®, our connected medication intelligence platform that integrates pharmacy operations, clinical workflows, and connected device data.

These may include:

  • pharmacist-led medication management

  • clinical oversight and care coordination where permitted

  • RTM/RPM and clinical support where permitted

  • digital tools and adherence devices (e.g., spencer®, PatchCap™)

  • patient and provider portals (e.g., oneMAR®)

  • routine pharmacy dispensing does not require a separate contract; device or monitoring programs may require enrollment or consent

Availability may differ based on jurisdiction, clinical authorization, payer coverage or licensure.
We do not guarantee improved outcomes or reduced utilization.

5. Devices, Connectivity & Data Transmission

Connected device functionality may depend on patient engagement, home connectivity, hardware setup, cellular/Wi-Fi/Bluetooth networks, or third-party services.
Data transmission may experience delays or interruptions. Alerts and monitoring are not guaranteed.

Users are responsible for device setup, power, and proper use.

6. Accounts & Portal Access

Certain features require account creation or identity verification. You agree to:

  • provide accurate information

  • maintain confidentiality of login credentials

  • notify Custom Health of suspected unauthorized access

Account access may be suspended or terminated for policy violations, misuse, security risk or fraud.

Platform-specific terms may apply and will prevail if inconsistent.

7. Permitted & Prohibited Use

You may use the Services only for lawful purposes. You must not:

  • copy, distribute, reverse engineer or decompile software

  • attempt to bypass security controls or access restricted areas

  • scrape, harvest or extract data without written permission

  • transmit malware, spam, or harmful content

  • interfere with system operation or modify code

Custom Health may investigate misuse and take action as permitted by law.

8. Intellectual Property

All website content, platform materials, software, data structures, user interfaces, workflows, and branding are the property of Custom Health or its licensors, and are protected by applicable intellectual property laws.

Protected marks used within the Services include:

Custom Health™, AdhereNet®, PatchCap™, oneMAR®, and associated logos and brand assets.
spencer® is used under exclusive distribution and operational rights; underlying intellectual property remains owned by its respective rights holder.

No right or license is granted to users unless explicitly authorized in writing.
Any unauthorized use, reproduction, modification, or distribution is prohibited.

9. Third-Party Services & Links

Services may include links to third-party websites or integrations. Custom Health is not responsible for external content, accuracy, privacy practices or security.
Use of third-party services is at your own risk and may require acceptance of separate terms.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available”.
Custom Health disclaims all warranties — express or implied — including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee uninterrupted service, error-free performance, or virus-free operation.

11. Limitation of Liability

To the fullest extent permitted by law, Custom Health is not liable for indirect, incidental, special, consequential or punitive damages, including loss of data, business, revenue, health outcomes or service interruption.

Where liability cannot be excluded, it is limited to the amount paid to Custom Health for the affected service in the prior 12 months.

Some jurisdictions may not allow these limitations; in such cases they apply to the maximum extent permitted.

12. Indemnification

You agree to indemnify and hold harmless Custom Health and its affiliates, clinicians, pharmacists, employees and partners against claims arising from misuse of the Services or violations of these Terms.

13. Changes to Terms

We may update these Terms periodically. Your continued use of the Services means you accept the updated version.
Material changes may be highlighted when posted.

14. Governing Law

  • Canadian users: governed by the laws of British Columbia, Canada

  • U.S. users: governed by the laws of Delaware, United States

Conflict of law principles do not apply.

15. Termination

We may suspend or restrict access for misuse or violation of these Terms. You may discontinue use at any time.
